The Novaly platform (including novaly.au, mobile apps, Novaly Plus, Novaly Connect, Novaly Get Matched, and Novaly OS) is owned and operated by Carden Group Pty Ltd, a proprietary limited company registered in the State of Victoria, Australia.

2. Third-Party Portals & Trademarks Disclaimer (REA, Domain, Homely & Meta)

REA Group (realestate.com.au):“realestate.com.au” and “Ignite” are registered trademarks of REA Group Ltd. Novaly is an independent software and community platform and is not sponsored, endorsed, or affiliated with REA Group Ltd. References to REAXML, third-party uploader feeds, or portal syndication refer strictly to technical compatibility with industry XML specifications.

Domain (domain.com.au):“Domain” and “Commercial Real Estate” are registered trademarks of Domain Holdings Australia Ltd. Novaly operates independently with no corporate affiliation or endorsement.

Homely (homely.com.au):“Homely” is a registered trademark of Homely Group Pty Ltd.

Meta Platforms (Facebook & Instagram):“Facebook,” “Instagram,” “Meta,” and associated marks are trademarks of Meta Platforms Inc. / Meta Platforms Ireland Ltd. Any social sharing or campaign exports adhere to Meta's developer policies and advertising guidelines.

Industry CRMs & Partners: References to Box+Dice, Agentbox, VaultRE, Rex CRM, MyConnect, Google Maps, Apple, or Stripe are used solely for descriptive and technical interoperability identification. All respective trademarks remain the exclusive intellectual property of their owners.

3. Real Estate, Financial & Legal Services Disclaimer

Not a Real Estate Agency:Neither Carden Group Pty Ltd nor Novaly is a licensed real estate agency, estate agent, stock and station agent, property manager, auctioneer, or buyer's agent. We do not act on behalf of buyers or sellers in real estate negotiations, contracts of sale, or residential tenancy agreements. An owner may advertise property they own. Novaly publishes that advertisement. The owner remains responsible for the price, the description, and the sale.

Not a Financial or Mortgage Broker: Novaly does not provide financial product advice, mortgage broking services, credit assessment, or tax advice. Any mortgage calculators, rental yield estimates, or market trends shown on the Platform are for illustrative informational purposes only and do not constitute financial advice.

Not a Building Contractor or Certifier:Novaly does not construct homes, perform structural assessments, issue building permits, or inspect building works. All “Builds” and architectural models listed on the Platform are posted by third-party builders and designers.

4. Mandatory User Due Diligence & Non-Reliance

All property listings, photographs, floorplans, price estimates, inspection dates, and builder specifications are provided by third-party agents, owners, and developers. Carden Group Pty Ltd does not independently verify the accuracy or completeness of any listing.

You expressly agree that you will not rely on any content on Novaly as a substitute for professional legal, financial, architectural, building, or pest inspections. You must conduct your own independent inquiries and seek advice from qualified legal conveyancers and licensed inspectors prior to entering into binding transactions.

5. Intellectual Property, Trademarks & Media Rights

“Novaly,” “Novaly OS,” “Novaly Connect,” “Novaly Plus,” and associated logos, visual marks, software code, algorithms, interface layouts, and branding are the exclusive proprietary intellectual property of Carden Group Pty Ltd.

Unauthorized scraping, copying, reverse engineering, republishing, or commercial exploitation of any platform software, database records, or visual assets without express written consent from Carden Group Pty Ltd is strictly prohibited.

6. Copyright Infringement & Takedown Procedure

Carden Group Pty Ltd respects the intellectual property of photographers, architects, visual artists, and agencies. If you believe your copyrighted work has been uploaded to Novaly without authorization:

  1. Identify the copyrighted work claimed to have been infringed.
  2. Provide the exact URL link(s) on Novaly where the infringing material appears.
  3. Include your full legal name, business entity, contact phone number, and email address.
  4. Provide a statement demonstrating your copyright ownership or authorized agency representation.
  5. Email your notice to legal@novaly.au. We review and process verified takedown requests promptly within 2 business days.
